Mistakes to avoid when writing your will

On Behalf of | May 17, 2022 | Estate Planning |

Creating a will is the responsible thing to do. After all, it ensures that your assets are distributed based on your wishes and helps reduce the likelihood that your estate will have to go through probate.

When you create a will, making sure you do it right is recommended. It’s a good idea to get help with this process to ensure everything is legal. It’s also important to avoid the mistakes found here.

Not having witnesses

Any legal document requires a signature. However, along with your signature, you need to have two people who witness you sign the document. These witnesses cannot be a beneficiary you have named in your will. If you don’t do this, your will may be considered invalid when you pass away.

No alternates named

What would happen if the beneficiaries or executor of your will die before you? If this happens, you need to ensure you have named “alternatives” in the document. If you haven’t done this, the court will appoint these individuals when you die.

Being unclear

Your will should include clear, simple, and concise language. This includes individuals’ names and descriptions of the property you pass to them. Being unclear can cause confusion when you pass away and it may also result in fallings out among your family members.

Creating a legal, hassle-free will

Creating a will isn’t a do-it-yourself process or something you should handle online. This is a legal document that will be used when you pass away. Because of this, you need to ensure you avoid the mistakes here and follow the letter of the law. This will help ensure that there are no issues or hassles that your family must deal with when you pass.
