Estate Planning, Elder Law Issues In Family Law Cases

No divorce is simple, but some divorce proceedings include complexities that benefit from review by an experienced elder law attorney with a comprehensive understanding of disability law and long-term care planning.

If your law firm is working with a client whose divorce proceeding involves an incapacitated spouse, a spouse with long-term care issues, or a child with special needs, the Denver estate planning and elder law attorneys at Chayet & Danzo, LLC, can assist. We provide consultation and co-counsel services to family law firms with disabled and incapacitated clients.

In situations in which one or both spouses has a capacity or care issue, we advise family law attorneys on long-term care needs, analyze available public and private benefits and eligibility requirements, and draft appropriate asset protection documents, including Special Needs Trusts and Disability Trusts.

While Colorado family courts require an equitable division of marital assets, additional assets may be needed to ensure appropriate long-term care of a spouse with a serious disability or degenerative illness. We can assist you in building your case.

Guardian ad Litem Services: Under the Colorado case of In Re Sorensen, current Colorado law states that, if there is a question of capacity of one of the parties in a divorce, a hearing must be held to determine the scope of incapacity and a Guardian ad Litem may be appointed to look out for the interests of the incapacitated spouse. We provide Guardian ad Litem services.
