We assist clients with issues related to estate planning, end-of-life decisions, disability and long-term care planning, fiduciary duties, burial and funeral directives, and public and private benefits. Probate Litigation - We represent personal representatives, heirs, beneficiaries, creditors, and other interested parties with any probate litigation matters that may develop during the administration of an estate or trust. Guardianships and Conservatorships - We provide counsel and representation to family members seeking to assist loved ones who are facing incapacitating illnesses or disabilities and are no longer able to manage care or finances. We also represent individuals who are objecting to the establishment or continuation of a protective proceeding for themselves or a family member. Medicaid, Medicare, Social Security, and Veterans Benefits - We assist clients in navigating the complexities of the various government benefit programs available to our veterans, elderly, or disabled. We help our clients plan for eligibility and then we work with our clients from the initial application through post-eligibility. We are also available to litigate denials of benefits through the administrative hearing process. Disability, Personal Injury, and Long-Term Care Planning - Our attorneys can advise you on accessing available resources for your needs arising out of a disability or advancing age to help families or individuals prepare for the future. We create a road map for coordinating public and private benefits so that our clients know which benefits to apply for and when. We develop legal strategies for asset protection, future rising care costs, and maintaining benefit eligibility. Our practice encompasses all aspects of planning, counsel, and advocating for the senior or disabled client. Health, Disability, and Long-Term Insurance - There are a variety of private insurance options, including short-term and long-term disability insurance, that are available through employers or individual policies. Employees also have rights under COBRA to continue employer based benefits, through private payments, after termination of employment. Many of our clients have also purchased long-term care insurance policies to protect their future. However, too often clients who have a qualifying event are uncertain how to maximize the benefits they already have. We help our clients understand their policies to ensure their claims are processed appropriately, including appealing denials of benefits through the internal review processes used by insurance companies. Estate Planning - We help clients plan for the future and that of their family by preparing important estate planning instruments. These include wills, trusts, durable powers of attorney, medical powers of attorney, and living wills. Estate and Trust Administration - We assist by providing counsel and representation to the personal representatives, trustees, heirs, and beneficiaries of an estate during the normal course of administration. Estate Planning - Our office advises and represents clients in regard to estate planning tools that can help them protect more of what they've earned, help disabled or elderly people qualify for Medicaid without becoming impoverished, establish a business continuity plan, and leave a will. Special Needs Trusts - Families with disabled children or elderly parents can create a special needs trust to ensure their future medical needs are provided for. We explain how to establish a special needs trust and what checks and balances can be put in place to ensure it is managed and administered correctly. Will Contests Our office represents clients in cases involving allegations of undue influence and competency in contested wills. Our attorneys consult medical experts, psychologists, and investigators in collecting and evaluating the evidence involved. Representation of Fiduciaries - The roles of agent, conservator, guardian, personal representative, and trustee encompass tremendous duties and often require legal representation to complete transactions, interpret documents, and deal with creditors and beneficiaries. Our firm works with both family members and professionals acting in a fiduciary role. We are able to defend fiduciaries' actions if and when challenged by a beneficiary through litigation and mediation. Real Estate Transactions - We assist clients with real estate transactions necessary to achieve their estate and business planning goals or during the administration of an estate or trust. This includes residential and commercial leases, private party agreements, and contracts. Business Planning - Our firm helps Colorado business owners achieve their business goals through proper planning and action.
